Cast Technologies Inc. warrants that its castings will meet the material and process requirements that are stated on the Buyers part print and/or are expressly agreed upon in writing by both parties prior to the time of order. Castings will NOT be subject to rejection on the basis of any further, additional or unmentioned material or process requirements.
All castings that are claimed to be defective must be returned to Cast Technologies for review and must be accompanied by a Returned Material Authorization (RMA) number issued by the Cast Technologies quality department. Issuance of an RMA number does not infer our concurrence of the claim of defective castings. Unauthorized shipments, defined as those without an RMA number, will be rejected at our dock.
Our liability for defective castings shall be limited to repairing or replacing, at our option, the defective castings. It is a condition for this warranty that you notify us of the defect within 90 calendar days of the ship date of the part. There will be no allowances made for secondary operations, transportation, installation, or other charges. The repair or replacement represents our sole and exclusive liability for any defect or failure of the goods.
All USA shipments are shipped F.O.B. our dock. International shipments are shipped Ex Works (Incoterms 2012). Each delivery of castings shall be inspected promptly by the Buyer for damage, weight, and count. Buyer will notify Cast Technologies Inc. within 14 calendar days of shipment of any damage or miscount after which the shipment will have been deemed to have been accepted and no claims will be considered.
Pattern equipment is owned by the Buyer and is stored at Cast Technologies for the convenience and exclusive use of the Buyer. All reasonable care is taken in the handling, use, storage and protection of the Buyer’s property. However, it is the Buyer’s responsibility to maintain insurance coverage against loss by fire, theft, or other casualty.
Any pattern equipment that has not been used to produce castings for a period of five (5) years is considered inactive and will be returned upon notification of the Buyer. At that time, the Buyer may direct Cast Technologies to continue to store the inactive tooling. In that case, the Buyer agrees to pay a yearly storage fee to Cast Technologies for each set of inactive tooling or equipment that is stored.
All orders are subject to credit approval at the time of receipt. Payment shall be net cash thirty (30) days from the date of invoice, unless mutually agreed prior to order entry. Under no circumstance will the Buyer have any right of offset for deduction against Cast Technologies.
